2. Legal framework

The processing of personal data through this website is governed by the Swiss Federal Act on Data Protection (nFADP), in force since 1 September 2023. For individuals residing in the European Union, the General Data Protection Regulation (GDPR) also applies.

3. Data collected via the contact form

When you fill in the contact form, the following data is collected:

  • First and last name
  • Email address
  • Phone number (optional)
  • Nature of the dispute
  • Preferred method of contact
  • Preferred location for the mediation
  • Free-text message

This data is collected on the basis of your consent (Art. 6 GDPR, Art. 31 nFADP) and is necessary to establish an initial contact with a view to a possible mediation.

4. Purposes of processing

The data collected is used exclusively to:

  • Get back to you in response to your request
  • Assess whether mediation is suitable for your situation
  • Arrange an initial meeting

No commercial use, marketing, or profiling is carried out.

5. Recipients and processors

Your data is never passed on to third parties for commercial purposes. It is, however, processed by the following technical processors:

  • Tizoo (website host, Switzerland): technical storage of the form and sending of emails
  • Calendly Inc. (United States): if you use the Calendly appointment-booking button, you will be redirected to this third-party service, whose privacy policy then applies

For transfers to the United States (Calendly), the safeguards provided for by the GDPR (standard contractual clauses or the Data Privacy Framework) apply.

6. Retention period

Messages received via the form are kept for as long as necessary to handle your request, then:

  • 12 months maximum if no follow-up takes place
  • For the entire duration of the mediation process, then 5 years after the end of the mediation in order to meet any legal obligations or subsequent requests

7. Cookies and similar technologies

This website uses no advertising cookies and no browser-side analytics tools (no Google Analytics, no Meta pixel, etc.).

To measure traffic, we analyse our server access logs (pages viewed, date, browser, country) for aggregated statistics and security purposes. IP addresses are anonymised, no cookie or tracker is used, and no data is passed on to a third party. These logs are kept for a maximum of 30 days.

When you reach the site from an external link, an identifier that may be present in the address (the gclid parameter) can be sent with your request in order to measure the effectiveness of our communication efforts. This measurement uses no cookie and does not identify you personally.

The Calendly widget, when loaded, may set technical cookies necessary for its operation.

The website may use the browser's local storage (localStorage) to remember your language preference (FR/EN). This data stays on your device and is not transmitted.

8. Your rights

In accordance with the nFADP and the GDPR, you have the following rights:

  • Right of access to your data
  • Right to rectification of inaccurate data
  • Right to erasure (the "right to be forgotten")
  • Right to object to processing
  • Right to data portability
  • Right to withdraw your consent at any time

The website is served exclusively over HTTPS with a valid SSL certificate. Security headers (HSTS, CSP, X-Frame-Options) are configured. Form data is transmitted over an encrypted connection.

This policy may be updated to reflect legal or technical developments. The date of the last update is shown at the top of this page.
